Fearless Fund Amicus Brief
The Council on Foundations and Independent Sector filed an amicus brief in support of the Fearless Foundation, an organization led by Black women that helps combat underfunding in venture capital by providing grants, tools, and mentorship to women of color. The American Alliance for Equal Rights has sued the foundation, claiming that its program for Black female entrepreneurs is racially discriminatory. The amicus brief, filed December 12, 2023, argues that the Fearless Foundation's grant program is protected under the First Amendment because courts have held that a decision to donate to certain causes is expressive conduct, which is constitutionally protected speech. The Council and Independent Sector invite philanthropic and nonprofit organizations to sign on to a statement of support.
